Specific flights may require permission or approval
Under the Civil Aeronautics Act, flights in certain airspace or using certain methods may require advance permission or approval. Examples include flights over densely inhabited districts, at night, beyond visual line of sight, without maintaining the prescribed distance from people or property, for dropping objects or for transporting hazardous materials.
A commercial operator should therefore review the route, airspace, flight method, pilot, assistants and surrounding environment for each assignment.
Even where a customer asks for a flight on a fixed date, the operator may be unable to proceed if the required permission, approval, weather conditions or safety checks are not in place. Customer contracts should allocate responsibility for regulatory steps and address postponement, cancellation, the operator's safety judgment and conditions for refusing a flight.
Level 4 flights require a more developed operating structure
Japan's regulatory framework permits Level 4 operations: beyond-visual-line-of-sight flights without an assistant over areas where third parties may be present.
Such operations involve first-class aircraft certification, a Class 1 remote-pilot certificate, flight permission or approval and compliance with operational rules. A company considering Level 4 operations for logistics, security or infrastructure inspection should design the complete operating system, including incident response, insurance and coordination with local authorities, police and landowners.
If a company treats technical testing and regulatory planning as separate projects, it may discover significant obstacles only when it attempts commercial deployment.
Photography and surveying also raise privacy and rights issues
Photography and surveying by drone involve more than aviation law. They may also raise privacy, portrait-right, personal-data, property and facility-management issues.
Images captured over residential areas, factories, schools, hospitals or event venues may include faces, vehicle registration plates, private premises or trade secrets. Contracts should therefore define the permitted capture area, use of the resulting data, disclosure to third parties, retention periods, publication, masking of incidental content and confidentiality.
